Abstract

When a man or a woman under 20 years of age engaged in a sexual act with a child who’s under 16 years of age and more than three years younger than he or she, the authorities may dispense with prosecution, if there are «special circumstances». This contribution comments on the concept of «special circumstances» and a recent decision of the swiss Federal Court on that subject.
