Abstract

Medically assisted reproduction gives hope to a heterosexual couple to conceive a child after they have passed the natural reproductive age. However, the legislator intervened to regulate access to artificial procreation in Switzerland and to establish certain forms of behaviour as criminal offences in order to prevent abuse. This contribution will analyse the problems in formation of the parent- child relationship (under Swiss law) when a couple violates the rules governing access to medically assisted reproduction in Switzerland by going abroad.
